PL110/13 - Development Application - Child Care Centre - 23 Bellamy Street, Pennant Hills

 

 

Additional information with CHANGE to Recommendation

Group Manager?s Report No. PL110/13 at Section 2.8.4.2 notes that, to ameliorate access issues, a right turn bay should be constructed for south bound access and exit traffic from the site be limited to left out only.? Council?s traffic assessment also concludes that to prevent parents parking on the east side of Bellamy Street to drop off and pick up children ?NO STOPPING, 7:00AM ? 9:00AM, 2:30PM ? 6:00PM, MON to FRI? restrictions should be installed between the power pole at 28 Bellamy Street and power pole at the boundary of 24 and 22A Bellamy Street, subject to approval by the Hornsby Local Traffic Committee.

However, due to an administrative error, these conditions were not included in Schedule 1.? Accordingly, it is recommended that the following conditions be inserted to address these requirements:

11A.???? Right Turn Bay and Median Island

?????? A detailed design for the right turn bay with concrete median island constructed for south bound access is to be submitted to Council for approval prior to issue of the Construction Certificate.? Exit traffic is to be limited to left out only.? The design of the facilities shall be in accordance with the RMS guidelines, technical directions and Austroads standards.

44A.???? Installation of Traffic Control Measures

a)???????? The right turn bay with concrete median island for south bound access is to be constructed subject to the detailed design approved by RMS and Council.?

b)???????? The applicant must Install ?NO STOPPING, 7:00AM ? 9:00AM, 2:30PM ? 6:00PM, MON to FRI? restrictions between the power pole at 28 Bellamy Street and power pole at the boundary of 24 and 22A Bellamy Street, subject to approval by the Hornsby Local Traffic committee.

On 12 November 2013, the applicant emailed Council querying the wording of condition No. 46 which may result in conflict with Family and Community Services licensing requirements. Condition 46 relates to total number of children at the centre and the requirement to provide a minimum of one third of all spaces for the 0-2 year age group.

To clarify the intent of the condition, the following amendment to the wording of condition 46 is recommended:

 

46.??????? Number of Children

a)???????? The centre shall accommodate a maximum of 60 children.

b)???????? A maximum of 40 children at the centre shall be at, or above, 2 years of age as at 1 January of each calendar year.

 

RECOMMENDATION

THAT Development Application No. DA/679/2012 for demolition of existing structures and construction of a purpose built 60 place child care centre at Lots 9 and 10, DP 17123, No. 23 Bellamy Street, Pennant Hills be approved subject to the conditions of consent detailed in Schedule 1 of Group Manager?s Report No. PL110/13 as amended by LM13/13.

PL111/13 - Community Facility - Child Care Centre - 8 Dudley Street, Asquith

 

 

Additional information with CHANGE to Recommendation

Group Manager?s Report No. PL111/13 at Section 2.8.1 addresses the proposed number of children in the centre and condition 35 is recommended to address this requirement. Due to potential conflicts with Family and Community Services licensing requirements and to clarify the intent of the condition, the following amendment to the wording of condition 35 is recommended:

35.??????? Number of Children

a)???????? The centre shall accommodate a maximum of 40 children.

b)???????? A maximum of 32 children at the centre shall be at, or above, 2 years of age as at 1 January of each calendar year.

 

RECOMMENDATION

THAT Development Application No. DA/204/2013 for the demolition of existing structures and construction of a forty place child care centre at Lot 26 DP 9913, No. 8 Dudley Street, Asquith be approved subject to the conditions of consent detailed in Schedule 1 of Group Manager?s Report No. PL111/13 as amended by LM14/13.

PL63/13 - Development Application - Subdivision of One Allotment into Two and Erection of Two Detached Dwellings - 8 Flora Avenue, Mount Colah

 

 

Additional information with NO CHANGE to Recommendation

Due to an administrative error, the plans for the proposed dwelling-house on allotment 2 and the shadow diagrams for the development were omitted from the attachments to Group Manager?s Report No. PL63/13.? The plans are attached for the consideration of Councillors in determining the application.

 

RECOMMENDATION

THAT Council assume the concurrence of the Director-General of the Department of Planning and Infrastructure pursuant to State Environmental Planning Policy No. 1 and approve Development Application No. DA/440/2013 for the staged subdivision of one allotment into two, demolition of the existing dwelling house and construction of two detached dwelling houses at Lot 777 DP 752053, No. 8 Flora Avenue, Mount Colah subject to the conditions of consent detailed in Schedule 1 of Group Manager?s Report No. PL63/13.
