Statement by the Chairman:
"I advise all present that tonight's meeting is being audio and
video recorded for the purposes of providing a record of public comment at the meeting, supporting the democratic process,
broadening knowledge and participation in community affairs, and demonstrating
Council’s commitment to openness and accountability. The recordings of the non-confidential parts of the
meeting will be made available on Council’s website once the Minutes have
been finalised. All speakers are requested to ensure their comments are
relevant to the issue at hand and to refrain from making personal comments or
criticisms. No other persons are permitted to record the meeting,

OFFICERS’
RECOMMENDATION
THAT Development Application No. DA/1339/2018 for Torrens
title subdivision of one lot into two including alterations and additions to
the existing dwelling at Lot 1 DP 208907, No.60 Lonsdale Avenue, Berowra
Heights be approved subject to the conditions of consent detailed in Schedule
1 of LPP Report No.11/19.
PANEL’S CONSIDERATION AND DETERMINATION
The Panel considered the matters raised by an anonymous
written submission and by the objectors at the meeting. The panel attended a
view of the site with the independent planner, Ms Nicola Stainton. The panel
considered the concerns raised in the submissions and conclude that suitable
conditions of consent would address the issues of concern.
The Panel resolved to approve the proposed development
subject to the amendment of conditions below:
1.
Delete conditions No.11 and 43.
2.
Insert new condition as follows:
A 1.8m high timber lapped and
capped boundary fence be erected along the northern side boundary for the
entire length of the driveway (behind the front building line).
(Note:
Alternative fencing may be erected subject to the written consent of the
adjoining property owner(s).
3. Amend
Condition 46A to require the planting of a minimum of 8 trees across lots 1
and 2.
4. Amend
conditions 21, 33 and 35 by deleting the reference to trees 21 to 23
5. Add
new condition to require landscape screening of the two car spaces at the
front of lot 1 by retention and enhancement of the existing landscaping.
The reasons for this decision
are:
·
The proposed development complies with Hornsby Local
Environmental Plan and is generally compliant with the Hornsby Development
Control Plan 2013.
·
The proposed development does not create unreasonable
environmental impacts upon existing and adjoining development with regard to future
amenity and impacts on trees.
·
The proposed development is consistent with existing area
characterised by battle-axe sub-division. It is in the public interest as it
will provide a development outcome that will provide diversity of housing and
is a suitable use of the site.

THAT Development Application No. DA/1325/2018 for a cool
room at the Galston Community Centre at Lot 1 DP 632865, No. 37 Arcadia Road,
Galston be approved subject to the conditions of consent detailed in Schedule
1 of Report No. LPP10/19.
PANEL’S CONSIDERATION AND DETERMINATION
The Panel considered the matters raised in the public submissions.
The Panel
resolved to approve the proposed development in accordance with the
Officer’s recommendation.
The
reasons for this decision are:

The proposed development generally complies with the
requirements of the relevant environmental planning instruments and the
Hornsby Development Control Plan 2013.
·
The proposed development does not create unreasonable
environmental impacts upon adjoining development with regard to acoustic
impacts.

RECOMMENDATION
THAT
Development Application No. DA/509/2018 for demolition of existing structures
and erection of a 5 storey residential flat building comprising 25 units and
basement car park at Lot 4 DP 298426, Lot 9 DP 298427 and Lot 10 DP 1854,
Nos.4-8 Bellevue Street, Thornleigh be approved subject to the conditions of
consent detailed in Schedule 1 of LPP Report No. LPP14/19
PANEL’S CONSIDERATION
AND DETERMINATION
The Panel considered the matters
raised by the written submissions and the objector at the meeting including
the planting of suitable street trees and suitable noise controls from the adjoining
property. The Panel members are satisfied these matters have been addressed
by the amended conditions.
The Panel resolved to approve the proposed development
subject to the amendment to conditions below:
1.
Condition No. 49 - Replacement of street tree plantings of 2 x
Calistemon trees with 2 x Turpentine - Syncarpia glomulifera and 1 x
Calistermon
2. New
Condition 67A - Acoustic Certification
Prior to occupation of the residential flat
building, a certificate must be obtained from a suitably qualified Acoustic
Consultant and submitted to Council and the PCA confirming that the acoustic
measures recommended in Condition No.22 have been satisfied.
3. Modified
Condition No.15 (e)
A convex mirror must be designed
by an engineer and installed in the north-east corner of the basement ramp
between basement level 1 and basement level 2, or as required to ensure
vehicles may pass each other safely.
4.
New Condition No.1A – Amended Plans
To facilitate access for
residents to the communal open space at the front of the property, the two retaining
walls on either side of the pedestrian ramp entrance at the front of the
property shall be deleted.
Details of the amended plans
must be submitted with the application for a construction certificate.
Following Conditions relating to tree protection to
be deleted – Reason Street tree has been removed.
5.
Condition No.27 - Installation of Tree Protection Fencing -
Deleted
The
reasons for this decision are:
·
The proposal results in appropriate scale of development and
satisfactorily complies with the relevant provisions of SEPP 65, Apartment
Design Guidelines and the HDCP.
·
The proposed development does not create unreasonable
environmental impacts to adjoining development with regard to visual bulk,
overshadowing, solar access, amenity or privacy impacts.
·
The proposed development provides diversity of housing in the
R4 zone and will meet Council’s housing strategy.
