Statement by the Chairman:

"I advise all present that tonight's meeting is being audio recorded for the purposes of providing a record of public comment at the meeting, supporting the democratic process, broadening knowledge and participation in community affairs, and demonstrating Council’s commitment to openness and accountability.  The recordings of the non-confidential parts of the meeting will be made available on Council’s website once the Minutes have been finalised. All speakers are requested to ensure their comments are relevant to the issue at hand and to refrain from making personal comments or criticisms.  No other persons are permitted to record the meeting, unless specifically authorised by Council to do so.”

1                 LPP24/19    Development Application - Torrens Title Subdivision of One Lot into Four - 231 - 233 New Line Road, Dural

(DA/1335/2018)

OFFICER’S RECOMMENDATION

THAT Development Application No. DA/1335/2018 for Torrens title subdivision of one lot into four at Lot B DP 389094, No. 231-233 New Line Road, Dural be approved subject to the conditions of consent detailed in Schedule 1 of LPP Report No. LPP24/19.

 

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised by the written submissions and by the speakers at the meeting including traffic, trees, bushfire and related issues, Plan of Management provisions, including threatened species, precedent, heritage and amenity impacts. The Panel considered the concerns raised in the submissions and at the meeting and concluded that the recommended conditions appropriately address the issues of concern, with a change to condition No. 45(a) and (c) to require additional tree planting.

The Panel resolved to adopt the assessment report’s recommendation and approve the proposed development subject to the conditions contained in Schedule 1 of the report with a change to condition 45(a) and (c) to require the planting of 200 trees as offered by the Applicant in response to concerns raised.

The reasons for this decision are:

·                The proposed development complies with the requirements of the relevant environmental planning instruments and the Hornsby Development Control Plan 2013.

·                The proposed development balances the permissibility of the proposed subdivision with the long term conservation and management of the native vegetation communities on the site.

·                The recommended conditions of consent, as amended, appropriately respond to all issues raised in respect of the proposed development.

2                 LPP31/19    Development Application - Telecommunications Facility - Railway Land, Opposite Beryl Avenue, Mount Colah

OFFICER’S RECOMMENDATION

THAT Development Application No. DA/413/2019 for the construction of a telecommunications facility fencing and ancillary telecommunication equipment at Lot 1029 DP 1192343, Pacific Highway, Mount Colah be approved subject to the conditions of consent detailed in Schedule 1 of LPP Report No. LPP31/19

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised in the written submissions and by the objector at the meeting including visual impact, electromagnetic energy and health impacts.

The Panel resolved to adopt the assessment report’s recommendation and approve the proposed development subject to the conditions contained in Schedule 1 of the report.

The reasons for this decision are:

·                The proposal generally complies with the Hornsby Local Environmental Plan 2013, State Environmental Planning Policy (Infrastructure 2007), Telecommunications Act 1997, NSW Telecommunications Facilities Guideline 2010 and the Hornsby Development Control Plan 2013.

·                The proposal’s electromagnetic energy (EME) levels fall within acceptable exposure levels.

·                The proposal would provide a positive impact for rail users by improving the mobile network coverage in the locality.

·                The design, height and site location of the telecommunications tower is appropriate with respect to servicing the rail corridor.
