"I advise all present that tonight's meeting is being audio recorded for the purposes of providing a record of public comment at the meeting, supporting the democratic process, broadening knowledge and participation in community affairs, and demonstrating Council’s commitment to openness and accountability.  The recordings of the non-confidential parts of the meeting will be made available on Council’s website once the Minutes have been finalised. 1                 LPP12/20    Development Application - Demolition and Construction of a Five Storey Boarding House Development Comprising 45 Units - 20 and 22 Bellevue Street, Thornleigh

(DA/860/2019)

RECOMMENDATION

THAT Development Application No. DA/860/2019 for demolition of existing structures and construction of a 5-storey boarding house development comprising 45 units over a three-level basement and associated landscaping at Lot 17 Sec 3 DP 1854 and Lot 18 Sec 3 DP 1854, Nos. 20 and 22 Bellevue Street Thornleigh be approved subject to the conditions of consent detailed in Schedule 1 of Report No. LPP12/20.

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised in written submissions and by the speakers at the meeting including traffic, parking and vehicular access; naming of the development after Nurse Jane Starkey; erection of the notification sign; definition of the development including permissibility and height; noise, safety and disturbance impacts and management; privacy, schedule of finishes, size and number of units, impact on property prices, construction management impacts; PCA and solar panels.

The Panel resolved to adopt the officer’s recommendation and approve the proposed development subject to the conditions of consent contained in Schedule 1 of the report with the following amendments:

Insert new condition No. 1A to read:

1A.        Amendment of Plans

a)            The approved Boarding House Plan of Management & House Rules must be updated to reflect:

i)              A maximum of 84 lodgers and a site manager on site at any one time

ii)             No use of the common spaces after 10pm including for functions and events

iii)            Compliance with all conditions of consent

b)            The approved architectural plans are to be amended to relocate the bicycle parking area to Level 1 of the Basement Car Park.

c)             These amended plans must be submitted with the application for the Construction Certificate.

Amend condition No. 70(d) to read:

d)         Accommodates a maximum of 84 lodgers and a site manager at any one time, with a maximum of one person leasing any lodging.

Amend condition No. 71 to read:

71.        Boarding House Management

The use of the premises must be managed in accordance with the provisions of the approved Boarding House Plan of Management & House Rules as approved under this development consent and the following.

a)            The name and contact number of the Boarding House Manager must be displayed at all times on a sign provided both within the communal area and adjacent to the front boundary of the site and viewable from Bellevue Street in accordance with the following:

i)              The sign is to be no larger than A4 size.

ii)             The assigned manager must be contactable 24 hours/ 7 days a week.

b)            The approved Boarding House Plan of Management & House Rules must be updated to reflect:

i)              A maximum of 84 lodgers and a site manager on site at any one time

ii)             No use of the common spaces after 10pm including functions and events

Amend condition No. 76f) to read:

f)         Bicycle parking spaces are to be designed in accordance with AS2890.3-2015 Bicycle parking facilities and be relocated to Level 1.

The reasons for this decision are:

·                     The proposed development complies with the requirements of State Environmental Planning Policy (Affordable Rental Housing) 2009 and the Hornsby Local Environmental Plan 2013.

·                     The proposed variation to building setbacks contained within the Hornsby Development Control Plan 2013 are consistent with the approved residential flat building approved for this site.

·                     The proposed development subject to conditions does not create unreasonable environmental impacts to adjoining development with regard to visual bulk, overshadowing, solar access, amenity or privacy.

2                 LPP15/20    Development Application - Demolition and Construction of New Dwelling house - 6 The Promenade Cheltenham

(DA/1265/2018)

RECOMMENDATION

THAT Development Application No. DA/1265/2018 for the demolition of existing structures and the construction of a dwelling house at Lot 87 DP 9085, No. 6 The Promenade, Cheltenham be refused for the reasons detailed in Schedule 1 of LPP Report No. LPP15/20.

PANEL’S CONSIDERATION

The Panel was not required to consider the proposal as the application was withdrawn by the applicant prior to its determination in accordance with the provisions under Clause 52 of the Environmental Planning and Assessment Regulation 2000.

 

3                 LPP16/20    Development Application - Demolition of Existing Structures and Construction of an 11 Room Boarding House - 87 Palmerston Road, Hornsby

(DA/741/2019)

RECOMMENDATION

THAT Development Application No. 87 Palmerston Road, Hornsby for demolition of all existing structures and construction of a two-storey boarding house containing 11 boarding rooms, accommodating 17 lodgers and basement parking at Lot B DP 339544, No.87 Palmerston Road, Hornsby be approved as a deferred commencement subject to the conditions of consent detailed in Schedule 1 of LPP Report No. LPP16/20.

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised in written submissions and by the speakers at the meeting including saturation of affordable rental housing in the locality, traffic, parking and vehicular access; overdevelopment of the site; noise, safety and security; privacy and overshadowing impacts; location of the bin storage area; lack of communal open space and impact on property values.

The Panel resolved to adopt the officer’s recommendation and approve the proposed development as a deferred commencement subject to the conditions of consent contained in Schedule 1 of the report with the following amendments:

New condition 2A. to read:

2A.           Amendment of Plans

a)            The approved Plan of Management must be updated to reflect:

i)              A maximum of 17 lodgers including a site manager on site at any one time

ii)             Compliance with all conditions of consent

b)            The approved architectural and landscape plans are to be amended as follows:

i)              The bulky waste storage area is to be deleted from the front setback area and the provision of an 8m2 bulky waste storage area is to be provided in the basement;

ii)             The bin storage area is to be relocated to the basement and the site manager is to bring the bins to the street for collection.

iii)            Submission of an amended landscape plan for the front setback area including retention of tree No. 4 and provision of soft landscaping.

c)             These amended plans must be submitted with the application for the Construction Certificate.

Condition No. 5 be amended to read:

5.             Removal of Trees

This development consent permits the removal of trees numbered 5, 6, 7, 8, 9, 11, 12, 14 and 15 as identified in the Arboricultural Impact Assessment Report and Method Statement prepared by Glenyss Laws Consulting Arborist dated May 2020.

Note:  The removal of any other trees from the site requires separate approval by Council in accordance with Part 1B.6 Tree and Vegetation Preservation of the Hornsby Development Control Plan, 2013.

Amend condition 17c) and d)i) to read:

c)      A bulky waste storage area of at least 8 square metres must be provided in the basement.

d)          The bin storage bay must:

(i)        be located within the basement of the building; and

Amend condition No. 59 a)  to read:

a)            The trees approved for removal under this consent, being trees numbered 5, 6, 7, 8, 9, 11, 12, 14 and 15,  must be offset through replacement planting of a minimum of 4 trees in addition to the planting to be provided under the Landscape Plan prepared by Conzept Landscape Architects, dated 2/5/2020.

New condition No.66A to read:

66A.     Boundary Fencing

a)            Fencing must be erected along all property boundaries behind the front building alignment to a height of 1.8 metres.

b)            The exact location, design and costing for the erection of boundary fencing are to be the subject of negotiation and agreement in accordance with the relevant requirements of the Dividing Fences Act 1991.

Note:  Alternative fencing may be erected subject to the written consent of the adjoining property owner(s).

Amend condition No. 67(d) to read:

d)    Accommodates a maximum of 17 lodgers including the on-site manager at any one time.

The reasons for this decision are:

·                     The proposed development complies with the requirements of State Environmental Planning Policy (Affordable Rental Housing) 2009 and the Hornsby Local Environmental Plan 2013.

·                     The proposed development is consistent with the Hornsby Development Control Plan.
