"I advise all present that tonight's meeting is being video streamed live via Council’s website and also audio recorded for the purposes of providing a record of public comment at the meeting, supporting the democratic process, broadening knowledge and participation in community affairs, and demonstrating Council’s commitment to openness and accountability.  The audio and video recordings of the non-confidential parts of the meeting will be made available on Council’s website once the Minutes have been finalised. RESOLVED ON THE MOTION OF COUNCILLOR RUDDOCK, seconded by COUNCILLOR TILBURY,

THAT Council offers its sincere condolences to the family and friends of Mrs Robin Timmins OAM whose contribution to the community was significant.

1                 IM4/23        Hornsby Park - Stage 1 Embellishments - Tenders

RESOLVED ON THE MOTION OF COUNCILLOR TILBURY, seconded by COUNCILLOR MCINTOSH,

THAT Council:

1.         Proceed under the provisions of clause 178(1)(b) and (3)(e) of the Local Government (General) Regulation 2021, and decline to accept any of the tender submissions received for RFT5/2023 – Hornsby Park Embellishments (HPE) Stage 1 – Enabling Services and enter into negotiations with Bedrule Pty Ltd T/A TOBCO.

Council will not invite fresh tender submissions or applications as the RFT was advertised via multiple channels to allow any suitable supplier to respond. 

As Bedrule Pty Ltd T/A TOBCO provided the only tender response which is very close to meeting all the requirements set out in the RFT they are deemed the most relevant party to enter into negotiations with. Given the design and construct nature of the expected works, some items of the response need to be negotiated prior to a contract being finalised.

There would also be a significant incremental cost to Council to re-run the RFT process, and no realistic prospect that any other party would tender.

2.         Decline to accept all tender submissions received for RFT6/2023 – Hornsby Park Embellishments (HPE) Stage 1 – Canopy Sky Walk, Cable Bridge and Southern Lookout.

Council will not invite fresh tender submissions or applications, however, will complete further market investigations into means of delivering this aspect of the Hornsby Park vision and a further report will be presented to Council on options to progress the Canopy Skywalk and Cable Bridge.

3.         Proceed under the provisions of clause 178(1)(b) and (3)(e) of the Local Government (General) Regulation 2021, and decline to accept any of the tender submissions received for RFT7/2023 – Hornsby Park Embellishments (HPE) Stage 1 – Crusher Plant Platform and enter into negotiations with Landscape Solutions Pty Ltd.

Council will not invite fresh tender submissions or applications as the RFT was advertised via multiple channels to allow any suitable supplier to respond. 

As Landscape Solutions Pty Ltd provided the only tender response which is very close to meeting all the requirements set out in the RFT they are deemed the most relevant party to enter into negotiations with. Given the design and construct nature of the expected works, some items of the response need to be negotiated prior to a contract being finalised.

There would also be a significant incremental cost to Council to re-run the RFT process, and no realistic prospect that any other party would tender.

4.         Notes that the General Manager will, under delegation, accept the quotation received for RFQ8/2023 – Crusher Plant Admin Building from MAICO PROPERTY SERVICES PTY LIMITED along with the three associated quotations from D and JF Electrical Contractors and DOLPHIN PLUMBING.

5.         Provide the General Manager delegated authority to complete negotiations and enter into contracts for RFT5/2023 – Hornsby Park Embellishments (HPE) Stage 1 – Enabling Services and RFT7/2023 – Hornsby Park Embellishments (HPE) Stage 1 – Crusher Plant Platform.

6.         Endorse the development and delivery of tracks and lookouts proposed as RFT9/2023 Tracks and Trails and RFT10/2023 North-Western and Western Lookouts and proceed to Tender subject to available funds as outlined in the budget section of the Infrastructure and Major Projects Director’s Report No. IM4/23.

7.         Explore the development and delivery of an alternative, more cost-effective solution for the Southern Lookout.
