1                 LPP27/23    DA/121/2022 - Construction of a 5 Storey Residential Flat Buildings Comprising 60 Units - 23-27 Balmoral Street, Waitara

(DA/121/2022)

RECOMMENDATION

THAT Council assume the concurrence of the Secretary of the Department of Planning and Environment pursuant to Clause 4.6 of the Hornsby Local Environmental Plan 2013 and approve Development Application No. DA/121/2022 for demolition of existing structures and construction of a 5-storey residential flat buildings comprising 60 units with basement parking at Lots 31 & 32 DP 856714, Lots 1 & 2 DP 843067 and Lot 1 DP 103071, No. 23, 23A, 25, 25A & 27 Balmoral Street, Waitara subject to the conditions of consent in Schedule 1 of LPP Report No. LPP27/23.

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised in the written submissions and by the speakers at the meeting including translucent balustrading, overshadowing, construction traffic and parking in Balmoral Avenue, redevelopment potential of the adjacent townhouse site.

The Panel considered the Clause 4.6 submission and is satisfied that the applicant’s written request has adequately addressed the matters required to be demonstrated by Clause 4.6(3) of the Hornsby Local Environmental Plan 2013. Also, in accordance with Clause 4.6(4) of the Hornsby Local Environmental Plan 2013, the Panel is satisfied that the proposed development will be in the public interest because it is consistent with the objectives of the ‘Height of building’ development standard and the objectives for development within the zone in which the development is proposed to be carried out.

The Panel resolved to adopt the officer’s recommendation and approve the proposed development subject to the conditions contained in Schedule 1 of the report and the following amended condition:

Amend condition No. 2 to read:

2.               Amendment of Plans

a)               To comply with Councils requirement in terms of waste disposal, landscaping, ventilation and privacy, the approved plans are to be amended as follows:

i)                 The floor to ceiling height of the temporary bin holding area at ground level must be increased to ensure a minimum 2.1m ceiling height is achieved.

ii)               The elevation plans must be amended to ensure the finished floor level of the temporary bin holding room is at RL 175.8 to enable a gradient no steeper than 1:14 and a distance less than 10m to the street.  This will require the relocation of the entry door by 1 metre.

iii)              The wrap around balconies on Levels 1 to 3 identified as U.18, U.32 and U.46 at the rear of the complex must include minimum 1.5m high fixed privacy screens along the western edge/ elevation.

iv)              The ventilation shafts for the complex must be relocated to outside of the bin room in accordance with Part F6 Light & Ventilation of the BCA.

v)               The landscape plan must be amended to ensure the front fence is setback 1 metre from the Park Lane frontage to ensure landscaping in-front of the front fence and ensure the landscaping is consistent with the adjoining properties landscape frontage to the west.

vi)              The balustrading on the southern elevation balconies for U.19, U.20, U.33, U34, U.47 and U.48 are to be amended to be principally solid brick construction on the southern face, and are to replicate the architectural finishes of the balconies for U.14, U.28 and U.42.

b)               These amended plans must be submitted with the application for the Construction Certificate.

The reasons for this decision are:

·                 The Panel has considered the Clause 4.6 written requests from the applicant to contravene the Height of buildings development standard applying to the site that seeks to justify the contravention of the development standard by demonstrating:

o        that compliance with the development standard is unreasonable or unnecessary in the circumstances of the case, and

o        that there are sufficient environmental planning grounds to justify contravening the development standard.

·                 In respect of Clause 4.6(4) of the Hornsby Local Environmental Plan 2013, the Panel is satisfied that:

o        the applicant’s written request has adequately addressed the matters required to be demonstrated by subclause (3), and

o        the proposed development will be in the public interest because it is consistent with the objectives of the particular standard and the objectives for development within the zone in which the development is proposed to be carried out, and

·                 The development results in 55 additional dwellings in an area close to public transport, recreation and shops and contributes to the goals of the National Housing Accord by improving housing supply.

·                 The proposed development generally complies with the requirements of the relevant environmental planning instruments and the Apartment Design Guidelines.

·                 The proposed development does not create unreasonable environmental impacts to adjoining development with regard to visual bulk, solar access, amenity or privacy.

2                 LPP29/23    DA/389/2023 - Alterations and additions  to existing childcare centre - Jack and Jill Kindergarten, 1 Hall Road, Hornsby

RECOMMENDATION

THAT Development Application No. DA/389/2023 for alterations & additions to an existing child care centre at Lot 2 DP 565080, No. 1 Hall Road, Hornsby be approved subject to the conditions of consent detailed in Schedule 1 of the Independent Assessment Report.

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised in the written submission.

The Panel resolved to adopt the officer’s recommendation and approve the proposed development subject to the conditions contained in Schedule 1 of the report.

The reasons for this decision are:

·                 The proposed development generally complies with the requirements of the relevant environmental planning instruments and the Hornsby Development Control Plan 2013.

·                 The proposed development does not create unreasonable environmental impacts to adjoining development with regard to visual bulk, overshadowing, solar access, amenity or privacy.

3                 LPP33/23    DA/75/2023 - Demolition of existing structures and construction of a 5 storey residential flat building comprising 15 units - 10 Bouvardia Street, Asquith

RECOMMENDATION

THAT Council assume the concurrence of the Secretary of the Department of Planning and Environment pursuant to Clause 4.6 of the Hornsby Local Environmental Plan 2013 and approve Development Application No. DA/75/2023 for the demolition of existing structures and construction of a 5 storey residential flat building comprising 15 units, basement car parking and associated landscaping/civil works at Lot 56 DP 8437, No. 10 Bouvardia Street, Asquith, subject to the conditions of consent detailed in Schedule 1 of LPP Report No. LPP33/23.

PANEL’S CONSIDERATION AND DETERMINATION

The Panel considered the matters raised in the written submissions regarding additional traffic congestion and parking during construction and ongoing use.

The Panel considered the Clause 4.6 submission and is satisfied that the applicant’s written request has adequately addressed the matters required to be demonstrated by Clause 4.6(3) of the Hornsby Local Environmental Plan 2013. Also, in accordance with Clause 4.6(4) of the Hornsby Local Environmental Plan 2013, the Panel is satisfied that the proposed development will be in the public interest because it is consistent with the objectives of the ‘Height of buildings’ development standard and the objectives for development within the zone in which the development is proposed to be carried out.

The Panel resolved to adopt the officer’s recommendation and approve the proposed development subject to the conditions contained in Schedule 1 of the report.

The reasons for this decision are:

The Panel resolved to receive and note the report. The panel also notes that there is currently only 1 item on the report.
